Millwall away - League Cup - 1976
No 2 is r nilsson replied to fredmciverslovechild's topic in Sheffield Wednesday Matchday
I was there but too young to understand why Millwall fans were on our end when we were playing Charlton. I think I was just upset at the result. The cup seemed to mean more back then. -
Racist language at Leicester
No 2 is r nilsson replied to kelay's topic in Sheffield Wednesday Matchday
I’ve posted the same thing a few times but worth another post. In 30 years going to games with wife and 5 mixed race children (2 now grown up) I’ve never once experienced any racism, home or away. I’m sure it happens and it’s pathetic but it must be just the occasional idiot. -
Clive Betts MP SPEAKS OUT
No 2 is r nilsson replied to @owlstalk's topic in Sheffield Wednesday Matchday
When power is given to the regulator the EFL will finally be exposed to scrutiny as a self-interested members’ club. There have been a few exceptions like Reading but way too many clubs have been allowed to fall or suffer greatly. Clive is doing a wonderful job showing the EFL to the world as it really is, which may not do us any good right now but it opens the door for a regulator with real powers, which is long overdue. -
John Textor RE: lessons learnt…
No 2 is r nilsson replied to standerino's topic in Sheffield Wednesday Matchday
If it is Textor then he’s on record as saying that he wants to develop an integrated player development structure across a few clubs in different countries and that he was frustrated that Palace didn’t support his plans well enough with this. If he appoints a technical director to look at this (as well someone to run the club) then he may not be perfect but that’s got to be a huge step forwards -
If a group plans to look at this I would join them, assuming the model was right. I know a few others who would also. The trust seems to have done a lot of the dd already. Maybe they could pull an interested group together.

I agree the club needs to be sustainable, but the club is able to trade as a going concern only because. Chansiri agreed in the accounts to cover the losses. This creates an obligation that he has to fulfil, but has failed to.

Why are the EFL just watching us die?

Yes the threats worked in the end. It’s more difficult for us because we don’t have an obvious buyer yet, and all the loans and the ground sale is a mess. -

The reports say that the EFL would have disqualified Reading if he didn’t sell. I agree, technically he could have just said fine and let Reading fall out of the league, but the EFL still forced the issue as well as they could - eventually. I actually don’t know which way Chansiri would go if faced with this and possibly administration is a better option. The other problem is not having a clear buyer, in spite of all the talk. -

We could be suspended from the league, but in Reading’s case he sold within the deadline. We need a buyer ready to buy to do this - I don’t know if the consortium are ready. In Reading’s case they ordered a sale. I’m not sure what more jurisdiction they need. -

Insolvency is on the list. -

How do the disqualification rules apply if not to disqualify the owner from owning? -

We’ll hopefully see when they review Chansiri’s charges. I think it may be easier to enforce the disqualification if a buyer could be clearly identified and a reasonable price could be established. The terms of a deal are a whole other minefield that the EFL may use as an excuse for not acting. -

The EFL has rules for disqualifying owners of football clubs. They’re specific to football clubs. If they could be applied to disqualify Chansiri he’d be forced to sell, and remover as a director. The only possibility we have is insolvency, and under the current circumstances there’s a slim possibility that the EFL could be mover to act. The intention of these rules is to ensure football club owners are responsible and behave properly. Neither applies to Chansiri. -

I think the EFL should engage (not supersede) trained professionals to review the current position. The historic position was tenuous but as it stands now I think it may be difficult for an accountant to allow Chansiri’s statement to pay debts as they fall due to stand, and that the club wasn’t technically now insolvent, and arguably seeking to trade whilst insolvent. This is before we get into any arguments about the value put in the stadium sale etc. -

Apply the disqualification test to Chansiri. That’s what it’s there for. I don’t know if he’s technically breached any of the tests but there’s a good argument to say we’re insolvent and that his statement if covering the debts is misleading. -

It’s a good OP and I’ve thought the same. The bar for disqualification is high. I think the only way we could force the issue is if the trust can gather together some of the creditors (other than Chansiri’s other companies and HMRC) and issue a statement demand. After 21 days the creditors can issue a winding up notice. There are other rules specific to football clubs but I would hope this should be enough to get the EFL to act. It may be that HMRC acts first or that he limps along with the sky money but we can’t just watch this happen. -
Surely we're insolvent?
No 2 is r nilsson replied to alleycat's topic in Sheffield Wednesday Matchday
There are a few disqualification tests, but the bar is really high and the tests are vague. For fraud and criminal charges I would expect this to be a Court proven charge. For insolvency events the EFL may have some discretion in this case because he clearly can’t pay his debt as they fall due, but the test is 2 insolvency events, which makes it more difficult (and ridiculous). I would argue his failure to pay staff on many occasions and having to roll up the loan should be enough. On any reasonable arguments the tests should operate to stop him running the club to the wall, allowing the ground to decay to the point of being potentially dangerous, taking money out of the club but not paying players or other staff…etc. I’m hoping the trust is putting these arguments to the EFL. If we can’t win on the insolvency argument then we might just be able to (legally) dig into the transactions or his background to find anything at all illegal so we can demonstrate a breach of the tests. Like many in here the club is a big part of my life. It’s very hard to sit and watch this. I don’t know if the trust is putting together initiatives but even if it’s just helping out the unpaid staff I feel duty bound now to take some action. -
Amazing gesture. It’s got me thinking what I can do to help.

I think an administrator would be appointed before a liquidator is appointed to try to keep us going. There is a rule that all players and certain other creditors have to be paid before the club can play again. Hopefully a buyer would come in at this stage and tidy everything up. I see this as the most likely outcome if the EFL don’t step in now to make him sell. On the basis of his actions he seems to have some serious mental health problems and this needs to be taken out of his hands.
-
I think strictly it’s a different club but other clubs have done this and dragged their history with them.
-
The club is worth much more as a going concern. The liquidator has a duty to recover as much as possible for creditors. In our case that’s a sale of as much of the football club as possible.
-
We take a points deduction and the buyer (assuming all the stories are true) pick up the club on the cheap without having to deal with Chansiri. His only hope now is to receive compensation for DR, but I question whether he even has the mental capacity left to negotiate this. It looks as though he’s having a go. For everyone’s sake the EFL should step in now.

Theoretical question - trading whilst insolvent

There are a few local businesses but I don’t know the details. HMRC will possibly be the big one. Unpaid players may also want to bring a claim. -

This is the key point, and he clearly hasn’t been able to cover to losses for some time, in spite of statements in the accounts. I think to bring this to a head a creditor has to bring an action.
